Terms of Service

1. Acceptance of Terms & Parties
These Terms of Service ("Terms") constitute a legally binding agreement between Cread, Inc. ("Cread", "we", "us", or "our") and any person or entity ("User", "you") who registers for, accesses, or uses the Cread platform and services. By creating an account or using Cread, you confirm that you have read, understood, and agree to be bound by these Terms. If you are accessing Cread on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms. Cread is intended for business and professional use (B2B), and by using the service you represent that you are acting in a commercial or professional capacity. If you do not agree to these Terms, you must not use the service.
2. Service Description & AI Technology
Cread provides a cloud-based software-as-a-service ("SaaS") platform that uses artificial intelligence to help users create, generate, and publish advertising campaigns on Meta platforms (Facebook and Instagram). The platform integrates third-party AI models for text and image generation. You acknowledge that AI-generated content may be inaccurate, incomplete, or unexpected — a known limitation commonly called "hallucination." Cread does not guarantee the accuracy, completeness, legality, or commercial effectiveness of any AI-generated content. You are solely responsible for reviewing, editing, and approving all AI-generated content before use or publication. The service depends on third-party APIs (including Meta) and may be affected by changes or outages beyond our control. Cread reserves the right to modify, update, or discontinue any feature of the service with reasonable notice. Certain features may be announced or labeled as "coming soon" or "planned" on our website, pricing pages, or marketing materials. These announcements reflect our current development intentions and do not constitute a binding commitment to deliver, complete, or maintain any such feature. Cread shall have no liability for features that are delayed, modified, or never released. Without limiting the foregoing, integrations with additional advertising platforms — including but not limited to TikTok Ads and Google Ads — are planned future features and are subject to the same disclaimer: their announcement does not constitute a guarantee of availability, timeline, or scope.
3. Account Registration & Eligibility
To use Cread you must be at least 18 years of age and legally capable of entering binding contracts. If registering on behalf of a business, you warrant that you have the authority to do so. You must provide accurate, current, and complete information during registration and keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@cread.app if you suspect unauthorized access. Each account is for a single named user — sharing credentials or allowing multiple simultaneous users under one account is prohibited. Cread may use federated authentication (e.g., Google OAuth); if you lose access to your identity provider account, you may lose access to Cread. Cread reserves the right to terminate accounts created in violation of these requirements.
4. Acceptable Use & Prohibited Conduct
You may use Cread only for lawful purposes and in accordance with these Terms. You agree not to use the platform to generate, upload, or publish content that is unlawful, defamatory, fraudulent, obscene, or that infringes any third-party rights. You may not create deepfakes, impersonate real individuals without their verifiable consent, generate disinformation, or produce content violating Meta's advertising policies. Technical prohibitions include: attempting to reverse-engineer or decompile the platform; using automated bots or scrapers to extract data; attempting to bypass AI safety filters ("jailbreaking"); using the service to build a competitive product; and sharing account credentials with unauthorized parties. Cread may suspend or terminate any account found in violation of these prohibitions without prior notice or refund.
5. Intellectual Property
The Cread platform — including its software, source code, user interface, AI models, system prompts, algorithms, documentation, and trademarks — is the exclusive property of Cread, Inc. and its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the platform solely for your internal business purposes. You retain ownership of all content and data you upload to Cread ("Inputs"). By uploading Inputs, you grant Cread a limited license to process them solely to provide the service. Subject to full payment of applicable fees, you own the content generated by Cread on your behalf ("Outputs") and may use them for your commercial campaigns. Cread may use anonymized, aggregated data for service improvement and AI model refinement, without identifying you. Feedback or suggestions you submit to Cread become Cread's property and may be used without compensation.
6. Credits, Billing & Cancellation
Cread operates on a credit-based model. Credits are purchased via monthly subscription or one-time top-ups. Credits are non-refundable, non-transferable, and unused monthly credits do not roll over. By subscribing, you authorize Cread to charge your payment method on a recurring basis at the start of each billing cycle. Cread reserves the right to modify pricing with at least 30 days' written notice to your registered email. Continued use after a price change constitutes acceptance. You may cancel at any time through your account settings; cancellation stops future charges but does not generate a refund for the current period. EU and UK users who immediately access digital content expressly waive the 14-day statutory withdrawal right. For billing errors, contact support@cread.app within 30 days of the charge.
7. Third-Party Platform Integrations
Cread integrates with Meta (Facebook/Instagram) and other advertising platforms via public APIs. Cread may in the future integrate with additional platforms such as TikTok Ads and Google Ads; however, such integrations are planned features and their availability is not guaranteed. Cread is an independent technology tool and is not affiliated with, endorsed by, or a partner of Meta Platforms, Inc., ByteDance Ltd., Alphabet Inc., or any other third party. You are solely responsible for complying with the terms, advertising policies, and community standards of any platform you connect to Cread. Cread is not responsible for account suspensions, ad rejections, or policy enforcement actions taken by Meta or other platforms. Cread does not manage your advertising spend — all payments for ads are made directly between you and the advertising platform. Cread cannot guarantee uninterrupted service if third-party APIs are unavailable or changed. You are responsible for keeping your OAuth tokens and platform connections active.
8. Disclaimer of Warranties
THE CREAD PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CREAD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. CREAD DOES NOT GUARANTEE ANY SPECIFIC COMMERCIAL RESULTS, AD PERFORMANCE, RETURN ON AD SPEND (ROAS), CLICK-THROUGH RATES, OR OTHER METRICS. THE SUCCESS OF YOUR ADVERTISING CAMPAIGNS DEPENDS ON MANY FACTORS OUTSIDE CREAD'S CONTROL, INCLUDING META'S ALGORITHM, YOUR PRODUCT, AND MARKET CONDITIONS. ALL AI-GENERATED CONTENT IS PROVIDED WITHOUT WARRANTY OF ACCURACY, LEGALITY, OR UNIQUENESS.
9. Limitation of Liability & Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CREAD'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) FEES PAID BY YOU TO CREAD IN THE 30 DAYS PRECEDING THE CLAIM, OR (B) USD $100. IN NO EVENT SHALL CREAD BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. You agree to defend, indemnify, and hold harmless Cread, Inc. and its officers, employees, and service providers from any claims, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) content you upload, generate, or publish using Cread; (c) your violation of these Terms; (d) your violation of any third-party rights or applicable law; or (e) any actions taken by Meta or other platforms affecting your advertising accounts.
10. Governing Law, Disputes & General Provisions
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute not resolved informally within 30 days of written notice to support@cread.app shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English. Each party waives the right to participate in class actions or collective proceedings. Notwithstanding the foregoing, nothing in these Terms limits or waives any rights you have under mandatory consumer protection, data privacy, or other non-waivable laws of the jurisdiction in which you are located. In particular: residents of Colombia retain all rights under Ley 1480 de 2011 (Estatuto del Consumidor) and Ley 1581 de 2012 (Habeas Data); residents of the EU/EEA retain rights under applicable EU consumer protection directives; residents of Brazil retain rights under the LGPD and Brazilian Consumer Protection Code (CDC); residents of Argentina retain rights under Ley 25.326 and Ley 24.240. If any provision is found invalid or unenforceable, the remaining provisions remain in full force. For legal notices, contact support@cread.app.
